We assist in the development of employee handbooks and policies, items essential to defend against claims against the company for discrimination and harassment. The firm gives guidance to clients in making decisions about discipline and termination of employees, as well as wage and leave issues.
SGD&R represents clients in federal, state, and agency (including E.E.O.C. and N.J.D.C.R.) litigation and mediation for claims of wrongful discharge, breach of employment contracts, restrictive covenants and trade secrets, wage claims, alleged discrimination and retaliation under the ADEA, Title VII, ADA, FMLA, NJLAD, and other federal and state anti-discrimination and whistle-blower statutes.
We also help companies to protect their trade secrets and confidential information, by drafting written employment agreements and covenants, and helping companies take sufficient steps to identify and protect information that gives them the edge over competitors.
SGD&R also prosecutes employees and other persons who anonymously post confidential information or defamatory statements on the Internet. We recently prevailed on behalf of a public bio-pharmaceutical company in the first appellate decision in the nation setting forth the standard for revealing the identity of an anonymous poster.
The firm also represents companies in stock option litigation, recently prevailing for another public company, defeating a $15 million claim for stock options in federal court and on appeal. |
