David Wendel and Amos Gern settled a car accident case for a 75-year old Springfield resident for $300,000, in a suit against the driver and our client's Underinsurance Motorist coverage

Our client sustained the following injuries:Right (dominant) shoulder torn rotator cuff and labrum, requiring surgery, resulting in adhesive capsulitis (frozen shoulder) and post-traumatic stress disorder (PTSD), with major depression and anxiety. Our client further sustained aggravation injuries to her neck, low back, and right elbow and hand, and her husband also had a very credible loss of services claim. Pre-existing conditions to her right carpal tunnel, cervical and lumbar spines were proven to be asymptomatic prior to this May 24, 2019 accident.

Notably, the defense medical examiner causally related her right shoulder sprain and post-traumatic rotator cuff impingement, and the need for right shoulder arthroscopic surgery a year after the accident. Further, all mental health examiners for the plaintiff, defense and PIP carrier confirmed our client’s PTSD, and need for continued medication therapy to address her anxiety and trauma from this accident. We were able to settle the underlying claim for the driver’s full policy of $100,000, and secured an additional $200,000, just a week before court-mandated arbitration date, by additionally asserting a “bad faith” claim.
