Lawyers Amos Gern and James Meszaros settled a claim for $125,000 on behalf of a 67-year-old woman pedestrian who suffered left-shoulder and back injuries when she was knocked down by a truck in an intersection in Newark. The truck's driver denied that he struck the plaintiff.
On May 3, 2006, at approximately 7:30 a.m., the plaintiff was crossing Van Buren just past its intersection with Clifford Street. Suddenly a truck made a left turn onto Van Buren from Clifford. Just before it braked to a stop, the truck struck the plaintiff and knocked her to the curb. An ambulance crew transported the plaintiff to University Hospital, where she was diagnosed with left-shoulder and low-back contusions.
Plaintiff underwent a course of physical therapy, and lost several weeks of work from her job as a longtime public-school teacher's assistant. MRI testing of her shoulder eventually revealed a full-thickness tear of the supraspinatus tendon with retraction of the myotendon and superior migration of the humeral head. MRI testing of her back indicated disc bulging at various levels of her middle back, as well as various degenerative changes in her low back.
Plaintiff was required to undergo arthroscopic surgery on her left shoulder. Intra-operative findings confirmed a full-thickness tear of the rotator cuff, with retraction, which the plaintiff's orthopedic surgeon repaired. Plaintiff's recovery cost her several more weeks of lost time from work.
Attorneys Amos Gern and James Meszaros placed the case in suit and the lawsuit quickly settled before discovery was exchanged.
